Resolve infringement of DS software intellectual property (IP) with infringers/customers by...

  • Understanding DS products and offerings to determine nature of infringement and how to settle infringement,
  • Driving direct engagement with infringers and customers on compliance actions where a Direct Engagement is optimal, with tailored strategies and methods for negotiating resolution to unauthorized use of DS software,
  • Engaging infringing parties with well-prepared evidence and negotiate settlements that include past use and sell licensing if needed going forward,
  • Monitoring, controling, and coordinating activities amongst Investigation Firms, Audit Firms, and Law Firms in compliance-related actions in Japan,
  • Managing the program with Law Firms that issue soft and standard compliance letters with respect to qualified leads,
  • Drafting tailored letters, where appropriate, and submit to the Law Firm,
  • Partnering with internal/external Legal teams to use court systems when necessary to resolve infringement of licenses, and
  • Collaborating with DS Legal teams, in terms of the Letters of Engagement (LoE), Power of Attorney (PoA), and Legal Service Agreement (LSA) provided to those Law Firms that have been engaged to take action on anti-piracy and compliance matters.

 

Create and drive strategies for the DS anti-piracy and compliance program, which include the identification of infringements of software IP via innovative and constantly evolving technology tools and investigative techniques, by...

  • Developing, reviewing, and enhancing the infrastructure for the engagement of third parties in Japan who have been engaged to support or advance the strategy of the anti-piracy and compliance program,
  • Evolving the existing License Compliance Program to produce growth via strategic initiatives and provide an efficient and effective infrastructure to support the program,
  • Driving the Audit program to address non-adherence of software contract terms by customers, and
  • Proactively engaging and updating technology solutions to aid identification of software infringement.

 

Develop and manage the leads derived from information provided by internal and/or external sources by...

  • Investigating and executing quality leads, across Japan, using all available sources, and
  • Guaranteeing that all leads are followed up with phone calls and visits, where appropriate.

 

Drive those leads singly or in partnership with the Customer Value Engagement (CVE) sales teams and ultimately drive payment for past use from the infringements by...

  • Determining Engagement Type models to best address Customer Value Engagement/Geography dynamics, and
  • Providing Leadership for License Compliance in Japan, partnering with Customer Value Engagement Leaders and Brand Sales Managers, in support of objectives of the Program.

 

Investigate those organizations/individuals engaged in the illegal distribution of unlicensed or illegal DS software products by... 

  • Developing processes and build relationships with local Enforcement to execute raids when deemed necessary, and 
  • Working with Law Enforcement or Trade Bodies to disrupt or remove, through enforcement action, those organizations and individuals involved in the distribution of illegal/counterfeit DS products.

 

Additionally, provide accurate and timely forecasting of revenue and measurements of results by...

  • Supporting and working closely with the business to ensure that compliance leads are entered into My Sales Pipeline (MSP), and then opportunities are created by the relevant responsible person and properly managed in My Sales Pipeline (MSP), in a timely and accurate manner,
  • Managing, populating, and maintaining the License Compliance Case Management System in a timely and accurate manner, and
  • Managing the business with respect to the Expense to Revenue ration (E/R) and the optimal Return on Investment (ROI).

Should be educated to Bachelor’s degree level at a minimum

Experience in License Compliance or a role that requires a focus on analytical and investigative activities as well as negotiation experience with customers

Both audit and direct Sales experience preferred

Experience in cross-functional communication preferred

IT technical knowledge preferred

DS Product Knowledge including Licensing/Contracts a plus

Experience in legal activities including settlement agreements and enforcement a plus

Certified Information Systems Auditor, Certified Fraud Examiner, or Certified IT Asset Management Consultant preferred

Bookkeeping Level 2 or above, or Certified Public Accountant of any countries a plus
